Membership Terms and Conditions

These Membership Terms and Conditions apply to the Fine Line Academy Membership operated by FLTATTOOS PTY LTD, trading as The Academy by Fine Line Tattoos® (ABN 83634395896) (“The Academy”, “we”, “us” or “our”).
By purchasing a membership, you agree to these Terms and our Privacy Policy.
1. Membership eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase a membership.
Membership accounts are personal to the purchaser and may not be shared, transferred or resold.
You are responsible for keeping your login details secure and for all activity conducted through your account.
2. What your membership includes
Your membership may include access to:
The private member community
Live coaching and Q&A calls
Tattoo, artwork and design critiques
Portfolio reviews
Business, branding and career guidance
New training, resources and workshops
Member-only offers and benefits
Direct guidance from Cholo and other approved Academy contributors
The availability, frequency and format of individual benefits may vary. Current membership inclusions will be displayed on the membership sales page or inside the member portal.
Membership does not include access to the separate Online Training Course or eBook unless expressly stated at the time of purchase.
3. Membership commencement
Your membership begins on the date your first payment is successfully processed.
Access to the membership portal and community will generally be provided immediately after payment, although technical or account-verification delays may occasionally occur.
4. Membership fee
The membership fee is AU$148 per month, including GST.
Your first monthly payment is charged at checkout. Five further monthly payments will then be charged to your nominated payment method, resulting in six consecutive monthly payments.
The minimum financial commitment during the initial term is:
AU$148 × 6 months = AU$888, including GST.
5. Six-month minimum term
The membership has an initial minimum term of six paid months.
This is not a free trial or a cancel-anytime membership during the initial term.
By joining, you agree to complete all six monthly payments, except where:
You have rights to cancel under the Australian Consumer Law
We approve an early cancellation due to exceptional circumstances
We materially fail to provide the membership services
These Terms otherwise permit early cancellation
Not using the membership, missing live calls or failing to access the portal does not automatically release you from the initial six-month commitment.
6. Recurring payment authority
By joining, you authorise us and our payment provider to charge your nominated payment method:
AU$148 at checkout
AU$148 on approximately the same date each following month
Any further monthly membership fees after the initial term, until the membership is cancelled
If a billing date does not exist in a particular month, payment may be processed on the nearest available date.
You are responsible for maintaining a valid payment method and ensuring sufficient funds are available.
7. Renewal after the initial term
After you have completed the six monthly payments, your membership will automatically continue on a month-to-month basis at AU$148 per month unless cancelled.
There is no new fixed-term commitment after the initial six-month term.
We will send you a reminder before your membership moves into its ongoing month-to-month period.
8. Cancelling after six months
Once the initial six-month term has been completed, you may cancel your membership at any time.
Cancellation can be completed:
Through the membership portal; or
By emailing info@academybyfinelinetattoos.
Cancellation takes effect before the next billing date, provided the cancellation request is received before that payment is processed.
Once cancellation takes effect:
No further membership fees will be charged
Your access will continue until the end of the billing period already paid for
Fees already paid will not ordinarily be refunded for change of mind or unused access
We will provide confirmation when your cancellation has been processed.
9. Early cancellation during the minimum term
You cannot ordinarily cancel during the initial six-month term because you have changed your mind, stopped participating or no longer wish to use the membership.
You may request early cancellation due to serious illness, incapacity or other exceptional circumstances that materially prevent you from using the membership.
Requests must be submitted to info@academybyfinelinetattoos.
Nothing in this clause limits any rights you may have under the Australian Consumer Law.
10. Failed or overdue payments
If a payment fails, we may:
Attempt to process the payment again
Contact you to update your payment details
Temporarily suspend membership access until the outstanding payment is resolved
We will provide reasonable notice and an opportunity to correct the failed payment before permanently terminating your membership.
If the payment remains outstanding, we may cancel your membership and seek payment of amounts properly owing under these Terms.
We will not charge an unspecified late fee.
11. Refunds and Australian Consumer Law
Membership fees are not ordinarily refundable for:
Change of mind
Failure to participate
Missed coaching calls
Failure to use the portal or community
Dissatisfaction caused solely by personal preference
A member’s failure to apply the material or guidance provided
However, our services come with guarantees that cannot be excluded under the Australian Consumer Law.
For a major failure with the service, you may be entitled to cancel the service contract and receive a refund for the unused portion, or compensation for its reduced value.
If a failure is not major, we are entitled to an opportunity to correct the issue within a reasonable time.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
12. Live calls and coaching
Live calls may be scheduled, rescheduled or occasionally cancelled due to availability, illness, public holidays, technical issues or other reasonable circumstances.
Where practical, we will provide advance notice and arrange a replacement session, recording or comparable alternative.
Attendance at live calls is the member’s responsibility. Missing a scheduled session does not entitle the member to a refund, credit or membership extension.
Advice provided during calls is general educational guidance and may not address every member’s individual circumstances.
13. Recordings
Live calls, coaching sessions and community events may be recorded.
Recordings may capture your display name, voice, image, questions, artwork or other contributions.
Where a session will be recorded, we will provide notice. If you do not wish to appear in a recording, you may keep your camera off, use a different display name where permitted or submit your question privately.
Recordings are for member use only and must not be copied, shared, published, sold or distributed without written permission.
14. Community standards
Members must interact respectfully and professionally.
You must not:
Harass, bully, threaten or discriminate against another person
Share offensive, unlawful or inappropriate material
Publish another member’s personal information
Share another member’s artwork outside the community without permission
Record private discussions without consent
Spam, solicit or excessively promote unrelated products or services
Share membership login details
Copy or distribute paid Academy content
Misrepresent your qualifications, experience or relationship with The Academy
Use the community to engage in unlawful or unsafe tattooing practices
We may remove content that breaches these standards.
Except in serious cases, we will generally provide a warning and a reasonable opportunity to correct the behaviour before suspending or terminating access.
15. Suspension or termination by The Academy
We may suspend or terminate a membership where a member:
Seriously or repeatedly breaches these Terms
Engages in harassment, unlawful conduct or conduct that puts others at risk
Shares, copies or resells protected membership materials
Provides false or misleading account information
Fails to remedy an overdue payment
Attempts to compromise the security or operation of the platform
If we terminate your membership due to a serious or repeated breach:
Your access may end immediately
Fees already paid for the current billing period will not ordinarily be refunded
No future monthly payments will be charged after termination
Any rights or remedies available under law remain unaffected
If we terminate the membership for reasons unrelated to your conduct, we will stop future payments and provide any refund or remedy required by law.
16. Intellectual property
All Academy videos, recordings, templates, documents, frameworks, designs, written content, graphics, branding and other membership materials remain the intellectual property of The Academy or the relevant rights holder.
Your membership gives you a limited, personal, non-exclusive and non-transferable right to access and use the materials for your own education and professional development.
You must not:
Copy, reproduce or republish membership materials
Share materials with non-members
Upload materials to another platform
Sell, sublicense or commercially distribute materials
Remove branding, copyright notices or ownership information
Use our materials to create or deliver a competing course, membership or training program
17. Member artwork and submissions
You retain ownership of artwork, tattoos, photographs and other original material you submit.
By posting material inside the membership, you give us permission to display it within the private member platform and use it for providing feedback, critiques and membership services.
We will not use your work in public advertising or external marketing without your permission.
You are responsible for ensuring you have the right to upload and share any material you submit.
18. Confidentiality
The membership may involve members sharing personal experiences, business information, client situations and unfinished creative work.
Members must respect the confidentiality of these discussions and must not reproduce or distribute another member’s confidential information without permission.
19. Educational disclaimer
The membership provides tattoo education, professional development, feedback and general business guidance.
It does not provide legal, accounting, financial, medical or health advice.
No particular income, employment, client, business, artistic or career outcome is promised or guaranteed.
Results depend on factors including your experience, practice, participation, decision-making, local laws and personal circumstances.
Members remain responsible for:
Following applicable tattoo, health and safety regulations
Obtaining required licences, registrations and insurance
Working within their level of training and competence
Seeking appropriate professional advice where necessary
20. Member benefits and third-party offers
Member discounts, wholesale pricing, workshops and partner offers may be subject to separate eligibility requirements, availability, stock levels or third-party terms.
Unless stated otherwise, member benefits have no cash value and cannot be transferred or exchanged.
We will not materially reduce the core membership benefits during the initial six-month term without providing reasonable notice and an appropriate remedy where required by law.
21. Changes to membership fees
Your AU$148 monthly fee will not increase during the initial six-month term.
After the initial term, we may change the monthly membership fee by providing at least 30 days’ written notice.
If you do not agree to the new price, you may cancel before it takes effect.
Continuing the membership after the notified date means you accept the new price.
22. Changes to these Terms
We may make reasonable changes to these Terms to reflect:
Changes to the membership
Changes to technology or payment systems
Legal or regulatory requirements
Improvements to member safety or community operation
We will give reasonable notice of material changes.
Changes will not retrospectively increase your initial minimum financial commitment or remove rights that cannot legally be excluded.
23. Platform availability
We aim to keep the membership portal reasonably available, but uninterrupted access cannot be guaranteed.
Temporary interruptions may occur because of maintenance, updates, third-party outages or circumstances beyond our reasonable control.
Where a significant interruption occurs, we will take reasonable steps to restore access or provide a suitable alternative.
24. Privacy
We handle personal information in accordance with our Privacy Policy and applicable Australian privacy laws.
By joining, you consent to us using your information to:
Administer your membership
Process payments
Provide portal and community access
Communicate about membership services
Manage live events and support requests
25. Communications
You agree to receive transactional communications relating to:
Payments and failed payments
Account access
Membership inclusions
Coaching calls and events
Changes to fees or Terms
Renewal and cancellation
You may unsubscribe from promotional marketing, but essential membership communications will continue while your membership remains active.
26. Liability
To the maximum extent permitted by law, we are not responsible for indirect or consequential loss arising solely from how a member applies educational information provided through the membership.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising under the Australian Consumer Law.

We will review the complaint and respond within a reasonable time.
The parties agree to attempt to resolve disputes in good faith before commencing formal proceedings, except where urgent relief is required.
28. Governing law
These Terms are governed by the laws of Victoria, Australia.
The parties submit to the courts and tribunals of Victoria and any courts entitled to hear appeals from them.
